This Acceptable Use Policy (“AUP”) governs your use of ApexReach and is incorporated into the Terms of Service. Because ApexReach enables outbound email at scale, compliance with this AUP is essential to protecting recipients, our sending infrastructure, and our shared deliverability reputation. Violations may result in immediate suspension or termination.
Email & anti-spam compliance
You are solely responsible for your messages and must, at all times:
- Send only to business contacts for legitimate B2B purposes and where you have a lawful basis to do so.
- Comply with all applicable anti-spam and marketing laws, including CAN-SPAM (US), CASL (Canada), and the GDPR/ePrivacy regimes (EU/UK) where applicable.
- Include accurate header and “from” information and a truthful subject line.
- Include a valid physical postal address and a functioning, honored unsubscribe / opt-out mechanism.
- Promptly suppress recipients who opt out and never sell or transfer suppression lists.
Prohibited content & conduct
- No unlawful, deceptive, fraudulent, or misleading messages.
- No harassment, threats, hate speech, or sexually explicit, or malicious content.
- No malware, phishing, or links to harmful sites.
- No purchased, scraped-for-spam, or harvested consumer email lists; no sending to addresses obtained unlawfully.
- No impersonation of any person or entity, and no falsifying your identity or affiliation.
- No promotion of regulated or prohibited goods/services in violation of law. [COUNSEL: enumerate restricted categories.]
Platform integrity
- No attempts to circumvent sending limits, rate limits, or deliverability controls.
- No reverse engineering, scraping, or overloading the Service or its providers.
- No use that jeopardizes the deliverability or reputation of shared infrastructure.
Data sourcing & privacy
You must respect the privacy of individuals whose data you process, honor data-subject and opt-out requests, and only use lead data obtained through ApexReach for the legitimate outreach purposes permitted here and by law.
Enforcement
We may investigate suspected violations and may suspend or terminate accounts, remove content, and report unlawful activity. We may act immediately where a violation threatens recipients, third parties, or the Service.
